In Matter of Thomas v. United States Trucking Corporation (224 App. Div. 805; affd., 250 N.Y. 567) it appeared that claimant's husband while employed as a truck driver by defendant was required to deliver a truck load of freight at a pier on the North river in the city of New York. While he was engaged in assisting to unload the truck a watchman on the pier drew a revolver and fired at him, causing his death.
