(1) Motion to dismiss appeal denied.

(2) Motion to bring in parties granted; those persons mentioned in the moving paper who reside in the State of New York by personal service of the notice of appeal and notice of argument; those residing in the State of Kansas by service of the notice of appeal and notice of argument by mail, together with a copy of the order of this court upon the present motion, at least twenty days before the term of the court at which the appeal is to be brought on for hearing.
