Appeal by the petitioner from an order of the Surrogate's Court, Schoharie County, fixing attorney's fees. We are unable to say that the Surrogate improvidently exercised his discretion after reviewing the present record. Order affirmed, with one bill of costs to respondents filing briefs payable out of the estate. Gibson, P.J., Herlihy, Reynolds, Aulisi and Gabrielli, JJ., concur in memorandum by Herlihy, J.
