Smyrna Union Co-operative, Inc. v. Rockdale Creamery Corp.

Appellate Division of the Supreme Court of New York, Third Department
Nov 10, 1943
266 App. Div. 1046 (N.Y. App. Div. 1943)

Opinion

November 10, 1943.

Appeal from County Judge of Chenango County.

Appellant contends that the petition is insufficient and confers no jurisdiction on the County Judge to entertain the proceeding. While the pleading is not a model one, the allegations of the petition, taken in connection with the proof, clearly establish the relationship of landlord and tenant. The proof also shows that appellant was holding over after the expiration of its term without the permission of its landlord and after the tenancy had been properly terminated. Order affirmed, with costs. All concur.
