This matter having been duly presented to the Court, it is ORDERED that THOMAS J. SMITH, JR., of Eatontown is temporarily suspended from the practice of law pursuant to R. 1:20-11(b) and (c), effective immediately and until further order of the Court, and it is further

ORDERED that THOMAS J. SMITH, JR., is restrained and enjoined from practicing law during the period of his suspension.
