Motion for leave to appeal, etc., denied upon the authority of Matter of Siraguso v. Moore ( 273 N.Y. 59). As we construe the opinion of the Appellate Division in People ex rel. Simmons v. Jackson ( 1 A.D.2d 728), that court merely decided the merits of the application then before it.
