Opinion

July 10, 1967

Motion by respondent for the following relief with respect to an order of this court dated February 14, 1967, as amended by an order dated March 8, 1967, suspending the respondent from the practice of law for a period of two years commencing April 15, 1967: (1) for a rehearing and vacating of said order; (2) in the alternative, for a remand to the Referee for further hearing; (3) for leave to appeal to the Court of Appeals; and (4) for a specific declaration by this court as to whether the respondent's constitutional rights were considered in connection with this proceeding. In a separate order to show cause, respondent moves for a stay of the said order pending determination of the above application. The order to show cause contained a temporary stay. Motion, insofar as it seeks leave to appeal to the Court of Appeals, granted. In our opinion, questions of law have arisen which ought to be reviewed. In all other respects, motion denied. Beldock, P.J., Ughetta, Christ, Brennan and Benjamin, JJ., concur.
