Matter of Sachs

Appellate Division of the Supreme Court of New York, Second Department
Jun 1, 1933
240 App. Div. 720 (N.Y. App. Div. 1933)

Opinion

June, 1933.

Present — Lazansky, P.J., Kapper, Hagarty, Carswell and Tompkins, JJ.

Motion for reargument denied, with ten dollars costs. Motion for leave to appeal to the Court of Appeals denied. The testimony relating to respective advances for disbursements of appellant and his attorneys, though somewhat indefinite, permitted a holding that, substantially, each offset the other and justified the official referee's disposition of this relatively minor phase of the case.
