266 App. Div. 857 (N.Y. App. Div. 1943)

Opinion

June 14, 1943.

Present — Carswell, Johnston, Adel, Taylor, and Lewis, JJ.

Motion in disciplinary proceedings to confirm report of Honorable Leander B. Faber, Official Referee. The proof before the referee warranted the conclusion that the respondent had been guilty of conduct prejudicial to the administration of justice. (Judiciary Law, § 88, subd. 2.) The court confirms the report of the Official Referee except as to the punishment to be imposed. In view of all the circumstances, the misconduct of the respondent justifies a suspension from the practice of the law, which the court fixes at a period of five years. The respondent is suspended from the practice of the law for a period of five years.
