Matter of Riley

Appellate Division of the Supreme Court of New York, Second Department
Oct 16, 1950
277 App. Div. 993 (N.Y. App. Div. 1950)

Opinion

October 16, 1950.

Present — Nolan, P.J., Carswell, Johnston, Adel and Sneed, JJ.

Motion by petitioner to confirm an Official Referee's report and to be reinstated as an attorney and counselor at law. The motion is denied. On this application for reinstatement, as on any application for admission to the Bar, the burden is on the petitioner to establish that he possesses the requisite character and fitness for the practice of the law. The record clearly shows that petitioner did not sustain such burden.
