In a special proceeding by a mortgagor, pursuant to section 333-b Real Prop. of the Real Property Law, to cancel and discharge of record a certain mortgage upon its property, the mortgagee Grace appeals from so much of an order of the Supreme Court, Nassau County, entered December 7, 1960, and from so much of a decision of said court, as directs the cancellation and discharge of record of such mortgage upon payment of the principal and interest to the Treasurer of the County of Nassau, to be paid by him to the mortgagee. Order, insofar as appealed from, affirmed, with costs. No opinion. Appeal from decision dismissed; no appeal lies from a decision. Beldock, Acting P.J., Ughetta, Kleinfeld, Pette and Brennan, JJ., concur.
