Appeal and cross appeal dismissed, without costs, by the Court of Appeals sua sponte, upon the ground that the order appealed from does not finally determine the proceeding within the meaning of the Constitution (see New York City Tr. Auth. v Lindner, 56 N.Y.2d 713; Cohen and Karger, Powers of the New York Court of Appeals, § 43, subd [d], p 176).
