ORDER GRANTING COMMISSION'S MOTION TO DISMISS
On August 18, 2006, this Court issued an Order to Show Cause to respondent directing him to files a response within ten (10) days of the date of service. Thereafter, on October 31, 2006, this Court, in three separate actions pending against respondent, 45S00-0508-DI-373, 45S00-0511-DI-508, and 45S00-0512-DI-649, imposed indefinite suspensions on the respondent as a result of his continued failure to cooperate in these cases.
On November 9, 2006, the Indiana Supreme Court Disciplinary Commission moved to dismiss this cause, 45S00-0608-DI-289, with costs in the amount of $529.76. The Commission noted that if respondent sought reinstatement of his law license under Matter of Haughee, 45S00-0508-DI-373, 45S00-0511-DI-508, and 45S00-0512-DI-649, the issues raised by his suspension in this cause, 45S00-0608-DI-289, would be addressed in that reinstatement proceeding.
It appears that service of the Order to Show Cause issued in this matter on August 18, 2006, has not been achieved. The Commission continues to seek the dismissal of this cause, but without the imposition of costs due to lack of service.
And this Court, being duly advised now finds that the Commission's motion should be GRANTED
IT IS, THEREFORE, ORDERED that the Commission's Motion to Dismiss Cause No. 45S00-06008-DI-289 is hereby GRANTED, with no costs imposed due to a lack of service.
The Clerk of this Court is directed to send notice of this Order by certified or registered mail to the respondent or his attorney, and to the Indiana Supreme Court Disciplinary Commission.
