Appeal from State Industrial Board.


Claimant was employed as a nurse by the Flushing Hospital Dispensary from September 14, 1936, to January 6, 1941. In the course of her employment during the years 1938 and 1939 she was assigned by her employer to other hospitals for short periods of time. During the months of July, August and September, 1939, she was assigned to Homer Folk Hospital. The Industrial Board found that while in the latter hospital she was exposed to and came in contact with tubercular patients and that as a result she contracted tuberculosis. The Board also found that she actually became disabled from such disease on the 6th day of January, 1941. The evidence establishes that after the month of October, 1939, and up to the time of her actual disablement she was in contact with tubercular patients in her regular work as a nurse. From December 1, 1938, to November 4, 1939, the hospital was insured by the State Insurance Fund. From November 14, 1939, up to and including January 6, 1941, the appellant insurance company insured the hospital. The evidence sustains the award. Award affirmed, with costs to the State Industrial Board. All concur. [See post, p. 937.]
