Order unanimously reversed, with twenty dollars costs and disbursements to the appellant, and the motion granted on the authority of Matter of Pellegrini ( 248 App. Div. 526). The amendment of section 65 (Laws of 1938, chap. 625) has not changed the rule. Settle order on notice.
