Matter of Johnston v. St. Regis Paper Company

Appellate Division of the Supreme Court of New York, Third Department
Jan 24, 1957
3 A.D.2d 685 (N.Y. App. Div. 1957)

Opinion

January 24, 1957

Present — Foster, P.J., Bergan, Coon, Halpern and Gibson, JJ.

Motion for reargument, or in the alternative, for leave to appeal to the Court of Appeals denied, without costs. While the memorandum decision handed down by this court may have understated the length of time which elapsed between the performance of the work by the decedent and the time when he was found lying on the floor, that was not decisive of the court's determination.
