276 App. Div. 937 (N.Y. App. Div. 1950)

Opinion

January 18, 1950.

Present — Foster, P.J., Heffernan, Brewster, Bergan and Coon, JJ.

This is an appeal by an employer and its insurance carrier from an award of disability compensation in favor of claimant. Claimant was employed as a bartender and about May 15, 1947, he picked up a case of vichy water which slipped out of his hands, striking the toes of his right foot and injuring it and which finally resulted in the amputation of his right leg. The board found that there was causal relation between the accident and the amputation of the leg. The evidence sustains the finding. Award unanimously affirmed, with costs to the Workmen's Compensation Board.
