Order reversed, with $20 costs and disbursements, and the motion to dismiss the petition granted on the ground that the lease is not a lease on "a graduated scale" within the meaning of section 13 (L. 1946, ch. 273).
Glennon and Cohn, JJ., dissent and vote to affirm.
