Motion to dismiss appeal granted, without prejudice to appellant's moving to reopen the examination upon a proper showing of prejudice, or to proceed as she may otherwise be advised ( Tri-State Pipe Lines Corp. v. Sinclair Refining Co., 26 A.D.2d 285).
