Matter of Gluckstern's Restaurant, Inc.

Appellate Division of the Supreme Court of New York, First Department
Jun 17, 1952
280 App. Div. 776 (N.Y. App. Div. 1952)

Opinion

June 17, 1952.

Present — Peck, P.J., Callahan, Van Voorhis, Heffernan and Bergan, JJ.

The record sufficiently establishes that the petitioner and respondents are parties to a contract containing an arbitration clause. Whether the contract was intended to apply to the new restaurant on Norfolk Street, is a question which should be determined by the arbitrators. Order unanimously affirmed, with $20 costs and disbursements to petitioner-respondent.
