Present — Lazansky, P.J., Carswell, Johnston, Taylor and Close, JJ.


In a proceeding to settle the final account of the committee of the incompetent herein, order settling the final account and discharging the committee modified on the facts by reducing the allowance to the attorney for the committee from $750 to $350, and by reducing the allowance to the special guardian from $750 to $250. As thus modified, the order, in so far as appealed from, is unanimously affirmed, without costs. While in our opinion the allowances were excessive, there is no basis for the statement in appellant's brief that the affidavit submitted by the attorney for the committee was calculated to mislead the court.
