MATTER OF FARD G

Appellate Division of the Supreme Court of New York, Second Department
Feb 17, 2000
269 A.D.2d 447 (N.Y. App. Div. 2000)

Opinion

Submitted December 8, 1999

February 17, 2000

In a neglect proceeding pursuant to Family Court Act article 10, the mother appeals from an order of the Family Court, Westchester County (Edlitz, J.), dated January 26, 1998, which granted a petition for an extension of placement of the child.

Terry Kirschenbaum, Sleepy Hollow, N.Y., for appellant.

Alan D. Scheinkman, County Attorney, White Plains, N.Y. (Stacey Dolgin-Kmetz and Linda M. Trentacoste of counsel), for respondent.

Adam S. Cohen, Mount Vernon, N.Y., Law Guardian for the child.

CORNELIUS J. O'BRIEN, J.P., THOMAS R. SULLIVAN, GLORIA GOLDSTEIN, DANIEL F. LUCIANO, SANDRA J. FEUERSTEIN, JJ.

DECISION ORDER

ORDERED that the appeal is dismissed as academic, without costs or disbursements.

Since the appellant challenges an order which extended the child's placement with the Department of Social Services, the appeal is academic as the period of placement has expired (see, Matter of Latonia J., 249 A.D.2d 546; Matter of Carlos S., 243 A.D.2d 569;Matter of Ricardo R., 220 A.D.2d 431; Matter of Greg W., 213 A.D.2d 414).
