Appeal by the landlord from an order which granted a motion by the respondent tenant to confirm the report of an Official Referee that the premises here involved were residential and not business space, and denied a cross motion by the landlord to disaffirm such report and to fix the emergency rent for business space. Order unanimously affirmed, with $10 costs and disbursements. No opinion.
