Application for recovery of a penalty pursuant to CPLR 7003 (subd. [c]) dismissed, without costs, for failure of jurisdiction and upon the further ground petition is insufficient on its face. Gibson, P.J., Herlihy, Reynolds, Taylor and Hamm, JJ., concur.
