Resettled partial final decree of the Supreme Court, Nassau County, dated January 6, 1972, reversed, on the law and the facts, and new trial granted, with costs to abide the event ( Matter of County of Nassau [ Colony Beach Club of Lido], 43 A.D.2d 45, decided herewith). Munder, Acting P.J., Latham, Shapiro, Gulotta and Benjamin, JJ., concur.
