Oct 28, 1970
35 A.D.2d 765 (N.Y. App. Div. 1970)

Opinion

October 28, 1970

Appeal by the employer and its carrier from decisions of the Workmen's Compensation Board, filed May 8, 1969 and November 13, 1969. The board found claimant's activities constituted arduous work resulting in excessive strain beyond the ordinary wear and tear of life, and found an accidental injury arising out of and in the course of the employment. The board further found causal relation between the injury, coronary thrombosis, and death. Decisions affirmed, with costs to the Workmen's Compensation Board. Herlihy, P.J., Staley, Jr., Greenblott, Cooke and Sweeney, JJ., concur.
