Matter of Berman v. Berman

Appellate Division of the Supreme Court of New York, Third Department
May 5, 1943
266 App. Div. 805 (N.Y. App. Div. 1943)

Opinion

May 5, 1943.

The State Insurance Fund has appealed from an award in favor of claimant. The only issue involved is with respect to claimant's weekly wages. The appellant contends that a bonus of $1,500 was improperly included in the determination of the average annual earnings upon which the average weekly wages and rate of compensation were predicated. The evidence sustains the finding of the Board. Award affirmed, with costs to the State Industrial Board. All concur.
