Present — Foster, P.J., Bergan, Coon, Halpern and Zeller, JJ.


These three submitted motions in one form or another relate to the effect of the amendments to section 538 of the Unemployment Insurance Law (Labor Law, art. 18) by chapter 728 of the Laws of 1955, effective September 1st, providing for the appointment and compensation of attorneys for claimants on appeals to this court. The court invites the presentation of the views of the Attorney-General; of the attorney for the employer Dengler Bros., Inc., and attorneys for claimant Tiebout; and of the attorneys presenting the application of claimant Galitzer, upon the following questions of policy: (a) whether the assignment of counsel for claimants should be made from a panel of attorneys specially qualified in the field of unemployment insurance law; (b) whether the court should receive the nomination of counsel by claimants; (c) whether the employer should be heard on the question of the amount of fee to be allowed to an attorney appointed for a claimant to be paid by the commissioner. Presentation may be made on oral argument November 21st at 1:00 P.M., or by typewritten briefs filed on or before that day.
