Matter of Assimotos v. Coughlin

Appellate Division of the Supreme Court of New York, Fourth Department
Mar 4, 1988
138 A.D.2d 942 (N.Y. App. Div. 1988)

Opinion

March 4, 1988

Appeal from the Supreme Court, Orleans County, Miles, J.

Present — Callahan, J.P., Denman, Boomer, Pine and Davis, JJ.

Judgment unanimously affirmed without costs. Memorandum. From our review of the record, we find substantial evidence that respondents' action in discharging petitioner was not the product of bad faith but rather was the result of his unsatisfactory job performance (see, Matter of Kearney v. Coughlin, 110 A.D.2d 1010, 1012-1013).
