No. 10-07-00257-CV (Tex. App. Sep. 12, 2007)

Opinion

No. 10-07-00257-CV

Opinion delivered and filed September 12, 2007.

Appeal from the 412th District Court, Brazoria County, Texas, Trial Court No. 43671.

Before Chief Justice GRAY, Justice VANCE, and Justice REYNA.

MEMORANDUM OPINION

Delford B. Mathews, a prisoner, sent this Court a notice of appeal from an order of dismissal rendered by the 412th Judicial District Court of Brazoria County, Texas. This Court does not have jurisdiction over appeals from Brazoria County. TEX. GOV'T. CODE ANN. § 22.201(k) (Vernon Supp. 2006). Mathews also sent the Brazoria County District Clerk a notice of appeal from the same order. The district clerk is sending the notice of appeal to the appropriate appellate court.

Based upon the content of the documents filed and in an attempt to avoid unnecessary delay, we use Rule 2 to lift the notice requirements of Rules 42.3(a) and 44.3 and dismiss this appeal. Our action does not, however, prevent Mathews from filing a motion for rehearing in this Court to explain why he believes we have jurisdiction of this proceeding.]
