PRESENT:

Defendant having moved to vacate the dismissal of the cross appeal and to consolidate the appeal and cross appeal taken herein from an order of the Supreme Court entered in the Office of the Clerk of the County of Oneida on May 4, 2016,

Now, upon reading and filing the affidavit of Christopher J. Harrigan, Esq., sworn to March 16, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted, insofar as it seeks to vacate dismissal of the cross appeal, on the condition that defendant perfects the cross appeal on or before June 5, 2017, and

It is further ORDERED that the motion is granted, insofar as it seeks to consolidate the appeal and cross appeal, and said appeals are hereby consolidated for the purposes of perfecting and arguing the appeals.
