ORDER TO SHOW CAUSE

This case is calendared for trial at the April 4, 2022, Denver, Colorado Trial Session of the Court. On March 18, 2022, respondent filed with the Court a Motion to Dismiss for Lack of Prosecution, which means that the government is asking this Court to end Mr. Mashek's case and decide that he owes the amount shown in the government's Notice of Deficiency ("NOD") dated March 2, 2020, except that the government has conceded that no penalties are applicable. The government is requesting this action because Mr. Mashek has not been in communication with respondent's counsel with regard to his tax case. After due consideration, it is

ORDERED that respondent's Motion to Dismiss for Lack of Prosecution is set for Hearing at 10:00 a.m. on Monday, April 4, 2022, at the Denver, Colorado Trial Session of the Court commencing on April 4, 2022. It is further

ORDERED that, on or before April 1, 2022, petitioner shall show cause in writing as to why respondent's Motion to Dismiss for Lack of Prosecution should not be granted, and why the Court should not enter a decision showing that petitioner owes deficiencies in income tax due in the amount of $45,113.00 for the taxable year 2016, and $1,995.00 for the taxable year 2017.
