Marsiglia v. Marsiglia

Court of Appeals of Maryland
Apr 27, 1932
159 A. 914 (Md. 1932)

Opinion

[No. 55, January Term, 1932.]

Decided April 27th, 1932.

Divorce — Adultery.

The fact that a wife, after separating from her husband by agreement, received a male boarder in her apartment, he occupying one bedroom and she and her twelve-year-old son another, was not sufficient to support a charge against her of adultery.

Decided April 27th, 1932.

Appeal from the Circuit Court of Baltimore City (OWENS, J.).

Bill by Joseph Marsiglia against Bessie E. Marsiglia. From a decree for defendant, plaintiff appeals. Affirmed.

The cause was argued before BOND, C.J., URNER, OFFUTT, DIGGES, PARKE, and SLOAN, JJ.

Harry E. Parkhurst and R. Contee Rose, for the appellant.

Martin G. Kenney, for the appellee.

Unreported cases.
