This case is calendared for trial at the New York City, New York, Trial Session of the Court scheduled to begin February 27, 2023. On January 30, 2023, the parties filed a Settlement Stipulation and a Proposed Stipulated Decision resolving this litigation. A review of the Settlement Stipulation shows that the Statement of Account (Form 3623) referenced in its preamble is not attached. Upon due consideration and for cause, it is

ORDERED that the Settlement Stipulation filed January 30, 2023, is hereby deemed stricken from the Court's record in this case. It is further

ORDERED that on or before February 10, 2023, the parties shall file a revised Settlement Stipulation that includes the referenced Statement of Account.
