The reporter's record is overdue. The record was due August 3, 2023. On October 11, this Court ordered court reporter Kimberly Xavier to file the reporter's record on or before October 26, 2023. On October 30, 2023, Ms. Xavier requested an extension of time, which this Court granted, ordering the reporter's record filed by November 30, 2023. As of the date of this order, the reporter's record has not been filed.

Accordingly, we ORDER court reporter Kimberly Xavier to file the complete reporter's record in this appeal on or before DECEMBER 28, 2023. We caution Ms. Xavier that should she fail to file the complete reporter's record within the time stated, the Court will utilize whatever remedies it has available, which may include ordering that Ms. Xavier not sit as a court reporter until she files the complete reporter's record in this appeal.

We DIRECT the Clerk to send copies of this order to the Honorable Audra Riley, Criminal District Court No. 3, Dallas County; Kimberly Xavier, Official Court Reporter, Criminal District Court No. 3; and counsel for all parties.
