Manley v. State

District Court of Appeal of Florida, Fourth District
Nov 19, 2007
967 So. 2d 362 (Fla. Dist. Ct. App. 2007)

Opinion

No. 4D07-2839.

October 10, 2007. Rehearing Denied November 19, 2007.

Appeal from the Appeal of order denying rule 3.850 motion from the Circuit Court for the Seventeenth Judicial Circuit, Broward County; Ana I. Gardiner, Judge; L.T. Case No. 04-13997 CF10A.

Scott L. Manley, Crawfordville, pro se.

No appearance required for appellee.

We affirm the summary denial of appellant's rule 3.850 motion. We conclude that none of the grounds, including those raised in his amended motion, warrant an evidentiary hearing. We reject his argument that the trial court, when it denied his motion for rehearing, failed to consider his amended motion. Affirmed.

WARNER, KLEIN and STEVENSON, JJ., concur.
