Upon consideration by the court. Previously, this court had allowed review of a decision of the Court of Appeals determining that the appeal in this case would be allowed to proceed. Pursuant to a settlement, the parties now have moved independently to dismiss their respective appeal or cross-appeals. The motion by the Oregon Department of Justice to dismiss its appeal is granted. The motion by Freightliner LLC, Freightliner Limited, Freightliner Canada Ltd., Freightliner Holdings Ltd., and Freightliner Netherlands Holdings BV to dismiss their cross-appeal is granted. The motion by DaimlerChrysler North America Holding Corporation to dismiss its cross-appeal is granted. Appeal and cross-appeals dismissed.
