Malham v. State

District Court of Appeal of Florida, First District
Nov 14, 1995
662 So. 2d 747 (Fla. Dist. Ct. App. 1995)

Opinion

No. 95-2700.

November 14, 1995.

An Appeal from the Circuit Court for Hamilton County; David Bembry, Judge.

C. Dennis Roberts, Public Defender; David M. Valin, Assistant Public Defender, Live Oak, for appellant.

Robert A. Butterworth, Attorney General; Carolyn J. Mosley, Assistant Attorney General, Tallahassee, for appellee.

Appellant argues, and the state properly concedes, that the trial court erred in refusing to allow appellant to testify at the pretransfer hearing held pursuant to the Interstate Agreement on Detainers. We, therefore, reverse and remand for a new pretransfer hearing.

WOLF, LAWRENCE and BENTON, JJ., concur.
