Opinion

No. 2D12–4266.

Humberto MALDONADO, Appellant/Petitioner(s), v. STATE of Florida, Appellee/Respondent(s).

BY ORDER OF THE COURT.

This court's two orders to show cause dated August 22, 2012, and September 10, 2012, are hereby discharged, but this appeal is dismissed for lack of jurisdiction. The circuit court order under judicial review is a nonappealable order. See Pillaio v. State, 60 So.3d 565 (Fla. 2d DCA 2011).

Appellant's “notice/motion to voluntarily dismiss appeal based on the facts” is not accepted because it is conditional on account of the request for the dismissal to be without prejudice. See Hammerl v. State, 779 So.2d 410 (Fla. 2d DCA 2000).
