MEMORANDUM AND ORDER


On February 25, 2000, defendants' moved for (1) an order under this court's equitable jurisdiction either dismissing plaintiff's action, or alternatively, issuing a preclusion order and directing the return of all precluded documents to Woodhull Hospital; (2) for a protective order under the Federal Rules Civil Procedure 26(c) barring the disclosure of the medical files of eighteen patients; and (3) for an order disqualifying the law firm of Ambrose W. Wotorson from representing Yousef Mahadin whose interests are actually and potentially adverse to clients Mr. Wotorson is representing in another matter pending in this district.

On September 18, 2000 the court referred defendants' requests to Magistrate Judge Robert M. Levy to hear and report. The referral is hereby withdrawn.

So ordered.
