MOTION AND PROCEDURAL RULINGS

This cause is pending before this court as an appeal from the Court of Appeals for Cuyahoga County. On December 8, 2004, appellee Flow Polymers, Inc. filed a motion to adopt the merit brief filed by appellee Ohio Department of Job and Family Services. The deadline for filing appellees' briefs was December 6, 2004, and appellee Flow Polymers, Inc. failed to file a merit brief by that date. Whereas S.Ct.Prac.R. XIV(1)(C) prohibits untimely filings,

IT IS ORDERED by the court, sua sponte, that appellee Flow Polymers, Inc.'s motion to adopt the merit brief filed by appellee Ohio Department of Job and Family Services be, and hereby is, stricken.
