Pursuant to the decision of the Florida Supreme Court in Mackerley v. State, 777 So.2d 969 (Fla. 2001), which quashed our previous decision, see 754 So.2d 132 (Fla. 4th DCA 2000), we reverse Mackerley's conviction for first-degree murder and remand for a new trial.
