ORDER DISMISSING ACTION

By order dated January 13, 2003, the complaint of plaintiff David Mack was dismissed, with leave to amend on or before January 31, 2003. Decision on his application to proceed in forma pauperis was deferred.

To date, no amended complaint has been filed. Accordingly, this action is DISMISSED without prejudice, and the application to proceed in forma pauperis is DENIED as moot.

IT IS SO ORDERED.
