Opinion filed October 28, 1940

WATERS AND WATER, SUPPLY, § 75negligent construction of water main, causing walls of house to crack. Plaintiff properly had judgment in action against water company for damages to his house caused by cracks in the foundation and walls, where evidence showed that defendant used ditch-digging machine to dig water main in alley adjoining plaintiff's premises, and that the vibration from the machine caused the damage to the house, and measure of damages was properly held to be the reasonable cost of repairs.

Appeal from Circuit Court of St. Clair county; Hon. MAURICE V. JOYCE, presiding.

Affirmed. Heard in this court at May term, 1940.
