ORDER RE: DEFENDANT'S REQUEST TO COMPEL DEPOSITION


Currently pending before the Court is Defendant's request to take the deposition of John Rapacki for preservation purposes. As Defendant has filed a motion to dismiss for improper venue and the pretrial and trial dates have been vacated, the undersigned shall not issue a decision on Defendant's request at this time. If the Court denies Defendant's motion to dismiss, the undersigned shall issue an order regarding Mr. Rapacki's deposition forthwith.

IT IS SO ORDERED.
