ORDER

This case is calendared for trial at the Court's February 13, 2023, Atlanta, Georgia, Trial Session.

On January 12, 2023, docket entry 11, respondent filed a Motion for Continuance indicating that a continuance would allow the IRS Independent Office of Appeals (Appeals) an opportunity to work with Petitioner in hopes of settling this case. Respondent believes this case is susceptible to settlement by Appeals if this case is continued. Additionally, respondent has attempted to contact Petitioner's counsel on multiple occasions to obtain Petitioner's position on this motion but has so far been unsuccessful.

After due consideration, and for cause, it is

ORDERED that, on or before January 31, 2023, petitioner shall file with the Court a response to respondent's Motion for Continuance, filed January 12, 2023, docket entry 11.

Petitioner is advised that failure to respond to this Order could result in the granting of respondent's Motion for Continuance, filed January 12, 2023, docket entry 11.
