MEMORANDUM OPINION


On February 15, 2006, appellant filed a notice of appeal in this case. Appellant's brief was due on June 11, 2006. When appellant had not filed his brief by September 13, 2006, we ordered appellant to file his brief within thirty days or the appeal would be subject to dismissal. On October 13, 2006, appellant filed a motion requesting an extension which the Court denied. To date, appellant has not filed his brief.

The Court now has before it appellee's November 3, 2006 Motion to Dismiss requesting that this appeal be dismissed because appellant has not filed a brief. We GRANT appellee's motion.

Accordingly, we DISMISS the appeal. See Tex. R. App. P. 42.3(c).
