On Appeal from the 118th District Court Howard County, Texas Trial Court Cause No. 55035
Panel consists of: Bailey, C.J., Trotter, J., and Williams, J.
ORDER
PER CURIAM
Appellants, Lubbock Noret Premiere Cinema, LP and Lubbock Premiere Noret Cinema, LLC, recently filed an accelerated appeal from the trial court's October 3, 2022 order granting a temporary injunction. Appellants have now filed in this court an emergency motion to stay entitled "Appellants' Emergency Motion to Stay Order Granting Temporary Injunction, and Trial Court Order Granting Motion to Enforce Injunction by No Later Than November 3, 2022." Appellants request that we stay the temporary injunction, and its enforcement, pending resolution of this interlocutory appeal.
Because this court needs sufficient time to review the merits of Appellants' emergency motion, we issue a temporary stay, effective immediately. See Tex. R. App. P. 29.6 (permitting review of interlocutory orders entered while an interlocutory appeal is pending). This court's stay order is limited to matters relating to the enforcement of the trial court's October 3 order granting a temporary injunction; we do not stay any other proceedings in the trial court. See Tex. Civ. Prac. & Rem. Code Ann. § 51.014(a)(4), (b) (West Supp. 2022); see also Tex. R. App. P. 29.1. The stay order is also limited in time; enforcement of the October 3 order is stayed only until further order of this court-after this court has had sufficient time to review the merits of Appellants' emergency motion and any response filed by Appellee.
Furthermore, this court requests that Appellee, Noret Enterprises, LLC, file a response to Appellants' emergency motion to stay. Appellee's response is due to be filed in this court on or before November 10, 2022.
