Opinion

Gen. No. 41,586. (Abstract of Decision.)

Opinion filed April 14, 1941.

JUDICIAL AND EXECUTION SALES, § 9publication of notice in newspaper, sufficiency. Sheriff's sale of real estate was properly held not invalid because notice of sale was not published in a secular newspaper of general circulation, where such notice was published in the Southtown Economist, a paper published in Chicago, with varied features, which maintained a downtown office, carried legal notices, had a weekly circulation of 70,500 for each issue, circulated among all classes, and was sold from newsstands, and it did not matter that a large part of the circulation was in the south side of Chicago.

See Callaghan's Illinois Digest, same topic and section number.

Appeal from Circuit Court of Cook county; Hon. WALTER J. LABUY, presiding.

Affirmed. Heard in first division, first district, this court at February term, 1940.

Christopher E. Jones, for appellant;

Markman, Donovan Sullivan, for appellees;

John P. Sullivan, of counsel.
