The petition is granted and Ronald Richard Lowery is hereby granted a belated appeal from the December 3, 2004, order denying postconviction relief in Okaloosa County Circuit Court case number 00-836. Upon issuance of mandate in this cause, a copy of this opinion will be furnished to the clerk of the circuit court, who is directed to treat it as a notice of appeal. Fla.R.App.P. 9.141(c)(5)(D).

PETITION GRANTED.
